ASA Ruling on Ashlen Inc – The ASA has ruled that a paid-for Facebook ad for Ashlen Inc’s sword hair pin collection, which claimed it was a ‘last chance’ to buy items before the collection ends, was misleading. The sword hair pin collection was still available on Ashlen’s website 12 months after the ad first appeared. The ASA also found the absence of a closing date for the promotion was likely to mislead consumers, breaching the CAP Code (Edition 12) rule 3.1 (Misleading advertising) and rules 8.17.4.a and 8.17.4.c (Significant conditions for promotions). Ashlen Inc must now ensure future ads do not falsely claim collections are closing, and promotional ads include closing dates, unless they can prove no consumer disadvantage in omitting them.
