ASA Ruling on Kentesh Ltd – The ASA has ruled that a paid-for Facebook ad for Artssus, claiming their “Animals in the Forest” collection was closing down with a “Last chance” promotion, was misleading. The collection remained available several months later. The claims in the advert and absence of a closing date for the sale also breached the CAP Code (Edition 12) rule 3.1 (Misleading advertising) and rules 8.17.4.a and 8.17.4.c (Significant conditions for promotions). Artssus must ensure future ads accurately reflect product availability and include closing dates for promotions unless they can prove that omitting these dates does not disadvantage consumers.
