On a different level, it is likely that we shall never know whether the Victoria’s Secret executives responsible for launching the PINK sub-brand thought that years later that their employer would face a trade mark infringement action from Thomas Pink.
The issue is one of due diligence. By undertaking appropriate trade mark clearance searches it is possible to avoid future problems. But as with many issues, there will be a need to strike a balance.
